Conroe – If you are thinking of short selling your house, then you have probably about forensic loan audits. Some claim they are wonderful. "Your lender will approve your short sale right away", one so called expert claimed.

"Your lender is more likely to give you a loan modification after you discover they broke the law. And most loans were illegal during the crazy lending period we experienced recently", claims another.

Even more insane is the guy who claims, "Lenders will jump over themselves to approve your short sale flip offer." I didn't know if any of this stuff was true.

But, I did hear a story where a lender didn't care about the forensic loan audit. An agent I know was working with a woman who was trying to sell 3 houses.

He knew they were short sales and was glad to list them for sale. There was a guy involved who was supposed to be doing all the "negotiating" with the lender.

Little did this agent know this guy was trying to flip the houses. (Buy for X and resell for $10,000 more.) This guy had someone do a forensic loan audit.

He did this in an attempt to force the lender to approve the short sale. The only problem was the lender didn't care. The negotiators at the lender were not going to approve the short sale flip offer.

"We know this guy is trying to flip the house. We won't approve the short sale as long as he is doing that", they said.

This was despite the forensic loan audit that some claim will have lenders trip over themselves to approve the short sale. It appears they aren’t as eager as some people would have you believe.

Conroe – The Stop Foreclosure Institute recently received a question from Katie. Here was her question.

I am an agent and I am helping someone short sell their house. X Lender (to remain unnamed) claims that they have sent a short sale package to the seller a couple of times.

But, they haven’t because my customer has never received anything. What can I do? They won’t start the short sale process until they receive the filled out package back from the seller. Katie.”

Here was our recommendation to Katie. Katie, you need to find out who owns the loan. Most likely it isn’t X Lender.

Then, tell the lender representative person that you will contact the loan owner direct and let them know about their incompetence.

As an example, we recently told a negotiator at a large nationwide lender that we would contact all the VFW posts about their incompetence on a VA short sale.

Their incompetence was causing the VA loan program to lose money. We threatened to tell America's Veterans how this lender was wasting their money.

We even put together a press release. What did that negotiator do? She got the short sale approved ASAP. This lender had been dragging their feet for almost two months before that.

We were able to get another large national lender to start working on an FHA file right away, when we reminded about a 5 day turnaround requirement that is in the FHA short sale guidelines.

The basis for contacting the loan owner is that you are holding the servicer accountable. Don't kid yourself, it works. The people who stand to lose money are going to be angry that the lenders do such a lousy job.

Conroe – Even though lenders pretend to hate short sales, they actually benefit from short sales. Let me explain why.

A lender gets to sell the house at today's price, versus what it will be worth 6-12 months down the road. We just did a comparison and pulled up sold listings.

All of the listings were the same, very comparable, and located in 3 similar, comparable neighborhoods. All were less than 2 miles apart.

First, we looked up the average selling price per SQFT of homes that sold in a 3 month period. In spring 2009, all the homes sold for an average of $103 a SQFT.

Then, we pulled up houses in the same neighborhoods that sold after the bank had foreclosed on them. Those sales were 6-9 months later than the original sales.

6-9 months later, the average sales price of a home in these neighborhoods was $85 a SQFT. These homes average 1,700 a SQFT.

That means a 1,700 foreclosure sold for $30,600 less than it would have sold as a short sale six months before. Ouch! Sure, most short sales are cheaper than comparable bank owned or "seller with equity" sales.

But, we're bringing a tremendous amount of value to the bank. The other person that's getting value is the buyer. They get a better deal in today's market than buying a "seller with equity" or REO.

You, the seller is also getting a better deal. You get a lower deficiency and your credit is back to normal in 18-24 months.

Conroe – The Stop Foreclosure Institute recently received a question from Aggie. Here was Aggie’s Question.

“We received a short sale approval on the 1st. They will only pay the second mortgage $3,000. The problem is that the second mortgage wants $5,500.

We are arguing back and forth with the second mortgage. The negotiator there said management decided they won't take less.

I told her the final decision should come from the investors not from management. Any help greatly appreciated. Aggie.”

Here is the answer to Aggie’s Question. It sounds like the first is Fannie Mae or Freddie Mac. They will only pay $3,000 to the second.

To get the 2nd to take less money, you have to escalate the file. Contact the CEO, ask for a supervisor, etc. When you talk to the supervisor remind them they will get zero thru a foreclosure.

Now, you will need more bargaining power than a simple "reminder." How close is the first to foreclosing? If they are close, just play chicken.

Tell the negotiator that if the first forecloses and they lose everything, then you will be in contact with the CEO to let them know. Another tactic is to tell them the first is Fannie Mae and that is the most they will pay.

If you stay firm, refuse to take less, sell them on why they should approve the short sale on your terms, and threaten to contact the loan owner directly, then they will usually budge. We have gotten lenders to agree to lots of stuff by staying firm and refusing to back down.

But at the same time we stand firm we also go on the offensive. "If you don't approve this short sale and as a result you lose more money, then we will contact the loan owner, your stockholders, and the press", we tell them.

This business requires sales skills. Use your sales skills to sell the people at the lenders on approving the short sale. Thinking about a short sale?

Conroe – Short sales can drag out. It takes 1-2 months to sell the house. Then, the short sale negotiations start.

They can drag out for 3-6 months. In the meantime, if you aren’t paying on the mortgage, then the lender will be trying to foreclose on the house.

Here is a tactic you can use to delay the foreclosure process and even stop a foreclosure sale.

Here is a story from Alberto where he explains what to do.

"Here is what I had to do. In the case of looming foreclosure sale date then, I get the owner to go to the courthouse and file a petition with the foreclosure judge.

(The owner is the only one allowed to do this. I think the actual legal term is a motion.)

The seller will be asked to go to a hearing with the judge. The owner goes to the room where the judge is holding session. They sign in and wait to be called.

The owner will be only one allowed to speak and they must explain the situation. The owner explains that there is an offer on the property and that they need some time for the lender to process the short sale.

I always recommend that the seller take copies of everything to show the judge. They bring the sales contract and the buyer’s loan approval.

Most of the time, the judge will grant their request and extend the foreclosure sale date by 90 days. The only exceptions are when it has been postponed several times already.

Conroe – Here is a story that illustrates this point. An agent I know was hired to sell a 30 acre tract of land.

Several months earlier they had spoken with a buyer that was looking for a similar property.

However, the buyer had said they were looking for something closer into town. So the agent never told them about the 30 acres.

Another agent did tell them about it. They notified the buyers about the property and they decided to buy it.

In this case, the seller was fortunate that the property sold. But, it illustrates the importance of a realtor marketing their homes to their active buyers.

Those buyers already know and trust that realtor. They are the most likely prospects to buy the homes that agent has for sale.

Some buyers want a home with a pool. They are willing to spend $20,000 to $50,000 more for a home with a pool. Other buyers absolutely do not want a pool.

"Don't show me any pool homes", they tell their agent. If those buyers are not going to like the pool home once they see it, then what is the use trying to hide it.

Show it off. That is why a pool home should be marketed loud and clear as a "pool home." The same goes for other unique properties, such as waterfront properties.

Another good example is a home that backs up to a power line. A power line is a huge negative for most buyers. But, it is a big plus to other buyers.

I heard a story about a home that backed up to power lines. The sellers had a hard time selling it. They finally hired an agent that knew a certain home buyer would like it.

The perfect buyer for that home is a family that loves ATVS. They could ride their ATVs on the power line easement.

Most roads and neighborhoods are unfriendly to ATV riders. The power line gave them miles of trails to ride without being harassed.

A third example is homes located down a dirt road. These homes appeal to people with horses because the dirt road is a great place to ride a horse.

They don't appeal to people without horses (who wants to live down a dirt road?) This is why a home down a dirt road needs to be marketed to horse owners.

If you have a unique home, then you need an agent who can market it properly. More than likely, your home's unique features need to be proclaimed loud and clear.

In a few other cases, they don't. A good, experienced realtor will know what to do.

Conroe – When another agent brings a buyer to look at your home your realtor should follow up afterwards.

They need to get feedback on what the buyer thought of your home. If the buyer liked your home, then they will ask if they are thinking of making an offer.

Maybe the buyer likes your home, but won't make an offer for some reason. They want something repaired, or they have a concern about something.

Your realtor can then address any concern and increase the odds of a sale. If you agent actively follows up on showings, then it will work wonders for a sale.

They can handle buyer's concerns and close the sale. In one example, the buyers mistakenly thought a home wasn't in a certain school zone.

The agent talked with the school board and the confirmed the home was in that school zone. There are many other things that may pop up.

If your realtor follows up, then they can handle those concerns and get a buyer off the fence and convince them to buy your home.

Conroe – A lot of agents think buyers don’t like short sales. This is not true. In fact, many buyers prefer foreclosures and short sales over normal homes on the market.

They know that they are more likely to buy a home at a fair price when they buy a short sale.

We never have a problem getting buyers interested in our short sale listings. We have even had buyers fight over certain short sales.

In one instance, we received multiple offers on a property. The property had extra features that these buyers really wanted.

To the average buyer, the features didn’t mean much. But to these buyers they were worth a lot.

Conroe – Short sales can take a long time. The banks are difficult to deal with and many agents do not understand short sales and don't know what they are doing.

Because of this, many buyers shy away from short sales. Or, if they do make an offer, then they still continue to look at other properties.

If a better home comes on the market, then they will buy that home. Few fully commit themselves to purchasing that home.

Because of this many agents recommend leaving a short sale on the market, even when there is a contract in place. Recently, Bank of America even changed their policies specifically for backup short sale offers.

In my opinion, taking your home off of the market when we have an accepted contract is a mistake. The only exceptions are when the buyer puts up a large down payment or falls in love with a unique home.

We recommend keeping the home on the open market. All agents and buyers will be told there is a contract on the property and that they will be in backup position.

If the buyer really likes the house, then they will submit a backup offer. The whole process is frustrating and not straight forward.

But, we make the best of the situation and do what we can to make the process easier.
