Conroe – Short sales have a reputation for taking a long time. But, they can drag on even longer if the paperwork isn't submitted to the lender in a timely manner.
When the Stop Foreclosure Institute first started doing short sales, we were hesitant to submit anything to the lender until we had a 100% complete package.

That caused the short sales to drag out a lot longer. After a little while, we learned to submit the paperwork as quickly as possible to the lender.
It usually takes 30 to 60 days for the lender to assign a negotiator to the file. That gives us plenty of time to track down any missing paperwork.
We realized that we were wasting time if we waited 30 days until everything was perfect and then submitted the file. There is a common myth that you shouldn't submit short sale paperwork until it is 100% complete.
Let me explain why that myth just isn't true. A lot of lender have different special forms they wanted filled out specifically for them.
"Oh, you need the buyer and seller to sign the ABC Bank Contract Addendum", the short sale negotiator tells us. Besides, most short sale negotiators want things done certain a way.
Because of this it is almost impossible to put together a 100% perfect short sale file that will have exactly the way the lender wants it.
So make sure your agent submits your file quickly and follows up with the short sale negotiator to see if anything is needed. Thinking about a short sale?

Conroe – Many homeowners think they have lots of time. “We’ll put out home up for sale in a few months. I know the bank is working to foreclose on it, but we can wait”, they say to themselves.
In order to have a successful short sale, then your agent will need time to submit everything to the lender and for them to process it.

In addition, it can take a month or more for your home to sell. Buyers don’t always materialize in 2-3 days. If you are less than a month away from a foreclosure sale date, then we can help you.

Conroe – No one wants a deficiency on a short sale. It’s not your fault the housing market crashed. In fact, some people say that the banks and Wall Street are what caused the crash.

Here are four ways that you can reduce the deficiency amount on your short sale.
1. Negotiate with the lender. Many lenders will settle for substantially less than what they are owed. For example, we have seen lenders settle for as low as 10 cents on the dollar.
In one case, the lender lost over $100,000 on a short sale. They settled with the home owner for a $10,000 promissory note to be repaid over 10 years with zero interest.
Lenders will reduce the amount to settle for over time. They know that the longer they go without being paid, then the less likely it is they will ever be repaid at all. They agree to settle because they know that something is better than nothing.
2. Declare Bankruptcy. If your bankruptcy is approved, then you may be able to have all of the debt erased in a Chapter 7 Bankruptcy.
The problem is that not everyone qualifies for bankruptcy. The bankruptcy laws were changed in 2005 and made it much harder for the average American to qualify for bankruptcy. Talk to a bankruptcy lawyer to see if you qualify.
You may not meet the Bankruptcy “Means Test.”
3. Hire a good attorney. Find a good attorney that specializes in defending consumers from collections. Your attorney may be able to find a loophole in the law that makes the debt invalid.
Be careful that you find a lawyer that specializes in this category of the law. You don’t want to pay an attorney to learn on your dime. There are a lot of great lawyers that can help you.
4. Fight the lender’s collections on your own. This is much easier when you genuinely do not have the money to pay. Many people are just scraping by.
Every dime they make is being used towards paying rent, car payments, utilities, and food for your family. Most states will not allow a creditor to take food out of your mouth.
You can check with a good attorney to find out the laws in your state. There are also legal aid non profits that can give you advice on what to do to stop a garnishment or bank account seizure. Thinking about a short sale?

Conroe TX – We had a question about FHA short sales yesterday. We did some research on FHA short sales as a result. We stumbled upon something interesting.
We have a list of all of the things that FHA considers legitimate hardships for a short sale. Click here to view the actual list from FHA. The good news is that if FHA considers something a hardship, then it is likely that most lenders agree.

Here is the list of things that FHA thinks are a legitimate hardship for a short sale.
* Death of Principal Mortgagor.
* Illness of Principal Mortgagor.
* Illness of Mortgagor's Family Member. Extraordinary medical expenses are part of the equation.
* Death of Mortgagor's Family Member. Extraordinary expenses are part of the rational.
* Marital Difficulties.
* Reduction in income.
* Excessive Obligations. No loss of income. To quote FHA, "The delinquency is attributable to the mortgagors(s) having incurred excessive debts(either in a single instance or as a matter of habit) that prevent him or her from making payments on both those debts and the mortgage debt."
* Job Transfer.
* A Problem with the property such as poor quality construction, expensive repairs being needed, etc.
* Inability to Rent Property.
* Military Service where the person can't afford their house because their paycheck won't enable them to cover the payment.
* Unemployment / Job Loss.
* Business failure.
* High Energy Costs. Your income and everything else stays the same, but your utility bill shoots thru the roof.
To quote FHA, "All other factors remained the same, but sharp increase in utility cost(s) deferred funds that would have been available for the mortgage payment or costs associated with the removal of environmental hazards in, or near the property."
* Payment Adjustment. To quote FHA, "Delinquency began after either increase in P&I for ARM mortgage or after escrow analysis where one or more escrow item increased, including the spreading of the amount needed to repay an escrow shortage over the next year."

Conroe TX – Using your work on the credit report, you are ready to take action. You are now going to write a letter to the credit bureaus about the items you’ve highlighted and noted.

You are writing to the credit bureaus because they are the ones reporting the information – it is up to them to change what they report.
The goal is to get bad things deleted from your credit report in order to improve your score.
Do not go to Google, or bing and try to find a form letter than you should send in for this step! The credit reporting companies can spot those like a hunting dog can spot a duck.
You will not get anywhere with a “canned” letter, and will damage your chances of ever resolving issues.
Your letter should sound like you are frustrated (which you undoubtedly are), and should sound authentic. But, do sound polite and friendly.
Don’t sound like an expert, but do sound like you expect action. In this round of letters – your aim is to have the credit bureaus remove items that are hurting your credit score.
The bureau will then have to investigate your dispute and REMOVE any of the disputed items if they can’t prove them to be accurate (this involves them contacting the original creditor and verifying with them – all within the short 30 day window allowed by law).
Here is the basic outline to follow for your first round of letters you send:
At the TOP of the letter, put your name, SSN, current address (and state lived there for X years), and your DOB.
Say something about how you’ve just reviewed your credit report, and found items that are inaccurate.
List the items BRIEFLY. Say something like: “Chase Credit Card xxx-xxx-xxxx, listed for 30 days late. I have never been late on this account,” or “Citi Credit Card xxx xxxx xxx listed as collections. This is false.”
Note that you are upset / worried / distressed / embarrassed about these items, since you know they are negatively affecting your credit score.
Ask that these items be deleted from your report immediately.
Add Sincerely, and your name below. Sign the letter.
Include a photo copy of your driver’s license as proof that you are you making this request. Also include proof if you have it (credit card statement from the month where they say you were late when you weren’t.)

Conroe TX – The next step in going over your credit reports is to really rank the items being reported about you to find ones that are the most negative. Rank the negative items with the MOST negative ones given the lowest ranking.

You want to rank the ones that will cause the most damage to your credit score.
Here are the most damaging items (in order of damage amount): bankruptcy; foreclosure; repossession; loan default; court judgment; accounts in collections; payments that are past due; payments that are late; being denied credit; inquiries to open new credit.
One thing to note about disputing things on your credit report – items like court judgments and foreclosures and child support arrears are verified by a different system, and are rarely if ever disputable.
Here is one of the best suggestions that I have seen work well. Take a Sharpie pen, and mark on the unused copy of your report.
Circle the items you are disputing and write a SHORT note about why you are disputing that item – for example “Not my account” or “Not Late.”
I am not advising you to lie or make misleading statements when you write to the credit reporting company. However, I will tell you that if someone is reporting something about you, they should be able to prove that what they are saying is the truth.
The credit bureaus are required to check out and investigate all the disputes they get that are deemed to not be “frivolous or irrelevant.”
What that means is that you need to not dispute every single item on your report right now, and you need to be taken seriously.
This means DO NOT use the dispute form that they sent with your credit report. They see those forms as “frivolous” 9 out of 10 times.
DO NOT use their online dispute center – the credit bureaus don’t take those seriously because they think you can’t be too serious if you just click-click-clicked away to dispute it. Thinking about a short sale?

Conroe TX – One of the common reasons that people are concerned about a foreclosure or short sale in their history is because they are concerned about their credit score.

While it’s true that your credit score will be adversely affected by these items, it is also true that you can move past blemishes on a credit report.
You may want to consider doing some credit repair or credit restoration. It isn’t hard to do, and when taken step by step, it can be handled in an organized, manageable way.
The first step that you need to do is to get and review your credit report. I’m always amazed by the psychology of just this step.
Most people don’t want to pull their credit report because they “just feel” like it will be bad, and they don’t want to see it.
However, you won’t know where you are at or how to get onto the next phase of recovery until you figure out where you are at.
You have seen all the commercials, and can sing the jingles, for some of the places to get your credit report. There are pros and cons for any of the places you can get your credit report.
The two words of caution I offer here are:
1. You can get an annual free credit report (the one that the government requires the 3 credit reporting bureaus to provide) from annualcreditreport dot com.
However – if you choose this route – it is free, but it then bumps up the time that a creditor has to investigate any of your disputes from 30 to 45 days.
This isn’t a great option, in my opinion. You’ll understand why after you learn about the dispute process.
Also, be aware that this service doesn’t have to give you your 3 digit credit score – which you might want to know.
2. Most of the other services offer you a free 30 day trial period, and then you get “enrolled” in their credit monitoring program. If you aren’t one to keep track of the 30 day trial timeframe, you could end up sucked into paying for something that you wouldn’t normally want to spend monthly money on.

Conroe TX – The Stop Foreclosure Institute recently received a question from Dan. Here was Dan’s Question.
"I recently purchased another home and tried to sell my former home. It isn’t selling and I can’t afford to make both payments. The home won’t rent for even 1/2 of the mortgage payment.
An agent told me the house is worth about $50K under the mortgage amount. Is it realistic for me to try the short sale? The only hardship created was when I decided to move to a larger home for family. Dan."

Here was our answer to Dan’s Question. Dan, I think you can short sale your house. Do you have a legitimate hardship?
I know you said you needed a larger house. However, if you also moved for a job transfer, then most lenders would consider that a legitimate hardship.
A hardship is not black and white. Some lenders would consider your situation a hardship. More often than not they will approve the short sale.
Others would not and won’t work with you on a short sale. In addition, the lender may not work with you until you have missed a payment or two.
Whether or not you miss a payment is your decision. You should weigh your options and decide whether or not you can live with the resulting credit damage.
Many lenders will work with you on a short sale even before you have missed a payment. If you were working with us, then we would help you.
But, we would have the expectation that it would be a 6-12 month process. Make sure that you work with a competent short sale agent.
Look for someone that is a short sale expert. Ask them how many short sales they have sold.
Ask them if they have worked with your lender in the past. Then you will be able to judge whether they are qualified to help you. Thinking about a short sale?

Conroe TX – The Stop foreclosure Institute recently received a question from Tom about short sales. Here was Tom’s Question.
“My Ex-wife decided to Short Sell our former house. Unfortunately we both signed the mortgage when we bought the house together. I think that means I am still liable for the debt.
The court gave her the home in the divorce. The market has declined and the house is worth about 120k less than the mortgage amount.
I have a good job and some assets. Will I have to pay back the bank for the money they lose? (My ex is selling because of financial problems.)
Also, someone said I might have to pay income taxes on the written off debt. Is that true? Please help me out here. Sincerely, Tom.”

Here was our answer. Tom, you probably should talk to a good lawyer. This is not the standard short sale. There might be tax laws that will allow you to not be liable for the tax liability on the written off debt.
In my opinion, the Tax Law allows you to write off most of the forgiven debt on a short sale. You have to short sell the house before the end of 2012 and have lived there for 2 of the last 5 years.
Your ex probably meets that criterion. I would think that since she lives in the house, then you wouldn’t be liable for the taxes. But, then again, I am not an accountant and don’t know how the law would affect such a unique situation.
Will you have a deficiency judgment? We can’t know for sure because there are so many variables involved. However, in about 80% to 90% of the time, you won’t have a deficiency.
That is because most lenders just forgive the debt. They have found it tough to collect the upside down debt. Most people are short selling because of financial problems.
They are struggling to avoid bankruptcy without a large deficiency judgment. When they see a $100,000 deficiency, then they will probably just declare bankruptcy. Then the lenders gets nothing anyways.
Check with a competent short sale realtor in your area. They will be able to give you a good idea of whether or not you will have to pay the deficiency. Thinking about a short sale?
